1. Introduction

Welcome to NicheTerra. These Terms of Service. (“Terms”) govern your access to and use of our Job board, mobile applications, and services (collectively).

By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree, you must not use the Services.


Account Registration

To fully access the Platform and its features, you may need to create an account. You agree to provide accurate and complete information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account.


Job Listings

As a User, you may have the ability to post job listings on the platform. You agree that all job listings you post will be accurate, lawful, and comply with applicable laws and regulations. You are solely responsible for the content of your job listings and any consequences arising from posting inaccurate or misleading information.

Eligibility

You must:

  • Be at least 18 years old or the legal age in your jurisdiction
  • Have the legal capacity to enter into binding contracts
  • Use the services in compliance with all applicable laws

Employers represent that they have authority to post job listings and process applicant data.

Description of Services

The platform provides:

  • Job listings posted by employers or recruiters
  • Job search and application tools for job seekers
  • Employer branding and recruitment tools

We do not guarantee employment, hiring outcomes, or job availability.

User Accounts

You agree to:

  • Provide accurate and current information
  • Maintain the confidentiality of your login credentials
  • Notify us immediately of unauthorized access

We may suspend or terminate accounts for violations of these terms.

User Content

“User Content” includes job listings, resumes, profiles, messages, and other submissions.

You:

  • Retain ownership of your content
  • Grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute content for platform operation
  • Represent that your content is lawful and non-infringing

We may remove content that violates these terms or applicable law.

Prohibited Conduct

You agree not to:

  • Post false, misleading, or discriminatory job listings.
  • Post false or misleading details as a job seeker.
  • Collect personal data without lawful basis
  • Engage in fraud, phishing, or scams
  • Upload malware or harmful code
  • Violate employment, labor, or data protection laws

Fees and Payments

Where paid services exist:

  • Fees are clearly disclosed before purchase
  • Payments are non-refundable
  • We may change pricing with prior notice

Europe (EU/EEA) – GDPR Compliance

For users in the EU/EEA, we comply with the General Data Protection Regulation (GDPR):

  • Lawful bases include consent, contract performance, and legitimate interests
  • Data subject rights include:
  • Access
  • Rectification
  • Erasure (“right to be forgotten”)
  • Restriction and objection
  • Data portability
  • Users may lodge complaints with their local Data Protection Authority

Employers using the Platform act as independent data controllers for applicant data.

Nigeria – NDPR Compliance

For users in Nigeria, we comply with the Nigeria Data Protection Regulation (NDPR):

  • Personal data is processed lawfully and transparently
  • Users have rights to access, correction, and deletion
  • Data controllers (employers) are responsible for applicant data they process

South Africa – POPIA Compliance

For users in South Africa, we comply with the Protection of Personal Information Act (POPIA):

  • Personal information is processed for a specific, lawful purpose
  • Reasonable security safeguards are implemented
  • Users may request access, correction, or deletion of personal data

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid by you (if any) in the past 12 months

Nothing excludes liability that cannot be excluded under applicable law.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of:

  • Your use of the Services

  • Your violation of these Terms or applicable laws

Termination

We may suspend or terminate access:

  • Courts of that jurisdiction shall have exclusive jurisdiction
